Garantizar los derechos constitucionales es fundamental para proteger la dignidad y la libertad de las personas para ello los principios deben ser observados cumpliendo un respeto normativo de los derechos fundamentales, como la libertad; y, la seguridad jurídica, que deben ser protegidos y respetados por todos los poderes públicos más aun cuando las juntas de protección de derechos son las llamadas a garantizar la observación de las garantías constitucionales, por lo tanto los ciudadanos deben ser tratados de manera igual ante (...) la ley sin discriminación ni privilegios, el objetivo es determinar si en los procedimientos administrativos que serán judicializados se respetan los derechos constitucionales de los intervinientes. La investigación fue de enfoque cualitativo, con la aplicación de los métodos histórico lógico, analítico - sintético, inductivo - deductivo. Se estableció que, en la administración de justicia en el Ecuador por parte de los órganos llamados a tutelar derechos, inobservan el debido proceso vulnerando las garantías constitucionales teniendo responsabilidad los órganos de los poderes públicos en cuanto a legislar de manera clara con el propósito de cumplir los estándares internacionales de garantías constitucionales; como aporte se estableció la necesidad de normar y reforzar el criterio de los juzgadores para que su actuación sea apegada a respetar los derechos de los ciudadanos. Este trabajo trata de la importancia que tienen los estudiantes de medicina para responder a las demandas de atención médica en México; alude al proceso histórico que determina esta situación y la construcción de la categoría “médicos en formación”; refiere las condiciones laborales, educativas y de salud de los estudiantes de medicina en las unidades médicas, y su impacto sobre la calidad de la atención médica. Desde la perspectiva ética y de los derechos humanos se plantea que los programas de (...) educación médica, y en particular la categoría de “médicos en formación”, pueden, paradójicamente, violentar tanto el derecho a la educación como el derecho a la atención médica, y dañar tanto la salud de los estudiantes como la de la población por ellos atendida. Se concluye que debe desarrollarse un nuevo respaldo ético docente asistencial para educación médica en las unidades de atención médica. (shrink)

El propósito de este texto es abordar la problemática de las inteligencias artificiales y su incidencia en la sociedad contemporánea. Para ello, se realizan lecturas paralelas de las sociedades distópicas creadas por Isaac Asimov y Philip K. Dick. A partir de estas, se identifican algunos rasgos existentes en nuestro contexto inmediato, enfocándonos en tres ejes principales: la sociedad de vigilancia y control tecnológico, el problema de lo natural en los ciber-seres, y la visión del siglo XXI en la ciencia ficción (...) para analizar si esta es ilusoria o, por el contrario, forma parte de nuestra realidad inmediata. Todo esto con el fin de definir al género como un espejo de nuestro futuro, basándonos en la lectura de nuestro presente para interpretar los mundos posibles y el futuro como fuente de reflexión filosófica y tecnológica. En este artículo, analizaremos a grandes rasgos los elementos de la ciencia ficción de Isaac Asimov y Philip K. Dick, enfocándonos en aspectos como la naturalidad de los individuos, las sociedades de control y las líneas que separan lo humano de lo artificial como bases para la reflexión filosófica. A través de este ejercicio, examinaremos diversas obras de ambos autores, tales como El hombre bicentenario (Asimov 2019b), Satisfacción Garantizada (Asimov 2019a), La última pregunta (Asimov 2019a), ¿Sueñan los androides con ovejas eléctricas? (Dick 2017) y El hombre en el castillo (Dick 2021). El objetivo es identificar elementos que nos permitan interpretar el siglo XXI como una obra de ciencia ficción en constante desarrollo. (shrink)

In this paper, we introduce a dialogue between (post-)phenomenological and decolonial approaches to propose a sentipensante ethics. Emancipating from hegemonic approaches to ethics that privilege rationality over feeling bodies, we conceptualise an analogical ethics of virtues that emerge in the framework of an analectic-responsive experience. In this experience, we specify the affective, interoceptive, and inter-bodily aspects as elements of a sentipensante ethics from an enactivist perspective. This exercise allows us to highlight the foundation of the ethical experience as a participatory (...) virtue-making oriented towards solidary well-being. Finally, it invites us to search for pedagogical practices that cultivate this virtue-making. En este artículo introducimos un diálogo entre enfoques (post-)fenomenológicos y decoloniales para proponer una ética sentipensante. Nos emancipamos de perspectivas hegemónicas que privilegian la racionalidad sobre los cuerpos que sienten, y conceptualizamos una ética analógica de virtudes que emergen en el marco de una experiencia responsiva analéctica. De esta experiencia, precisamos los aspectos afectivos, interoceptivos, e inter-corporales, como elementos de una ética sentipensante desde una perspectiva enactivista. Este ejercicio nos permite resaltar el fundamento de la experiencia ética como un hacer-virtud participativo orientado hacia el bienestar solidario. Finalmente, nos invita a buscar prácticas pedagógicas que cultiven este hacer-virtud. (shrink)

This paper presents two formation tracking control strategies for a combined set of single and double integrator agents with an arbitrary undirected communication topology. The first approach is based on the design of distance-based potential functions with interagent collision avoidance using local information about the distance and orientation between agents and the desired trajectory. The second approach adds signed area constraints to the desired formation specification and a control strategy that uses distance as well as area terms is designed to (...) achieve tracking convergence. In the present paper we address the problem of optical isomerism embodied in the socalled “Hund’s paradox”, which points to the difficulty to account for chirality by means of quantum mechanics. In particular, we explain the answer to the problem proposed by the theory of decoherence. The purpose of this article is to challenge this answer on the basis of a conceptual analysis of the phenomenon of decoherence, that reveals the limitations of the theory of decoherence to solve the difficulties (...) posed by optical isomerism and, in general, by quantum measurement. The modal-Hamiltonian interpretation belongs to the modal family of interpretations of quantum mechanics. By endowing the Hamiltonian with the role of selecting the subset of the definite-valued observables of the system, it accounts for ideal and non-ideal measurements, and also supplies a criterion to distinguish between reliable and non-reliable measurements in the non-ideal case. It can be reformulated in an explicitly invariant form, in terms of the Casimir operators of the Galilean group, and the compatibility of the MHI with the (...) theory of decoherence has been proved. Nevertheless, perhaps its main advantage in the eyes of a scientist is given by its several applications to well-known physical situations, leading to results compatible with experimental evidence. The purpose of this paper is to add a new application to the list: the case of optical isomerism, which is a central issue for the philosophy of physics and of chemistry since it points to the core of the problem of the relationship between physics and chemistry. Here it will be shown that the MHI supplies a direct and physically natural solution to the problem, a solution that does not require putting classical assumptions in “by hand.”. (shrink)

The main objective of this research is to identify the current panorama of scientific production associated with governance in university institutions. A bibliometric analysis was developed in Scopus using R Core Team 2022-Bibliometrix and Vosviewer software. The results highlight the countries with the highest productivity in the topic of study, with the most representative authors favoring the understanding of governance. The relationships among character strengths (forgiveness and gratitude), happiness, and pro-social bystander behavior in bullying were analyzed. The sample includes 500 (early adolescents) and 500 (middle adolescents) of both genders, between 12 and 18 years old (M age = 14.70, SD = 1.58). Two structural equation models were calculated. Results of the first model indicated that forgiveness, gratitude, and happiness had a direct positive relation with pro-social bystander behavior. Furthermore, human strengths were indirectly related to prosocial behavior in bullying for (...) this effect in happiness. The second model showed that pro-social bystander behavior had a positive effect on human strengths and happiness. Multi-group analyses indicated that gender and stage of adolescence did not moderate the relations found in the model. Overall findings suggest a reciprocal relationship between character strengths, happiness, and pro-social bystander behavior. (shrink)

In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. When reasoning about dependence relations, philosophers often rely on gradualist assumptions, according to which abrupt changes in a phenomenon of interest can result only from abrupt changes in the low-level phenomena on which it depends. These assumptions, while strictly correct if the dependence relation in question can be expressed by continuous dynamical equations, should be handled with care: very often the descriptively relevant property of a dynamical system connecting high- and low-level phenomena is not its instantaneous behaviour but its stable (...) fixed points (those in the vicinity of which it spends most of the time, after comparatively short transitory periods), and stable fixed points can change abruptly as a result of infinitesimal changes of the low-level phenomenon. We illustrate this potential gradualist trap by showing that Chalmers’ fading qualia argument falls into it. (shrink)

This article explores how historical narratives affect the evaluation of political decisions regarding justice during peace negotiations. Specifically, this study evaluates how different narratives of the Colombian armed conflict relate to the preference for either restorative or retributive justice. Results revealed that a historically accurate narrative that included structural elements correlated with the preference for restorative justice, whereas a schematic narrative that focused on individual greed favoured the preference for retributive justice. These results are explained in terms of the characteristics (...) of expert historical narratives, which include structural elements, such as economic and institutional factors. The presence of these elements in the explanation of conflicts decreases the weight of individual decisions and, in this way, prevent ingroup attributional biases. (shrink)

“Conciencia”, la sección inicial de la Fenomenología de Hegel, se ocupa de la comprensión del mundo físico que nos rodea. La sección siguiente, “Autoconciencia”, comienza a considerar nuestra comprensión de nosotros mismos y de los otros. Este orden de discusión no es ni arbitrario ni meramente conveniente. Por el contrario, una de las principales lecciones que hemos de aprender hacia el final del desarrollo de la “conciencia” es que nuestra mejor concepción del mundo que es el objeto de nuestras actividades (...) cognitivas es inteligible solo como una parte de un relato que además considera la naturaleza del sujeto que se dedica a tales actividades. La razón para esta transición expositiva es un aspecto importante en el idealismo de Hegel. En este capítulo ofrezco una reconstrucción racional de un argumento que veo como el soporte de esta transición y del tipo de idealismo que esta implica. (shrink)

Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. En este artículo se presentan las reflexiones epistemológicas del filósofo Francisco Fernández Buey (1943-2012), las cuales, han estado continuamente presentes en la obra del autor al menos desde la publicación en 1991 de La ilusión del método, y culminan en su obra póstuma Para la tercera cultura (2013) en una apuesta por la complementariedad entre ciencias positivas y reflexión humanística. Partiendo de un marxismo heterodoxo tanto en el plano ético-político como en el epistemológico, Fernández Buey apuesta por una idea de (...) ciencia alejada del positivismo, a la vez que critica las filosofías contrarias a aquella en la medida en que la consideran como un conocimiento meramente reductor de una realidad que no puede ser aprehendida por la ciencia. Desde el concepto de dialéctica de Manuel Sacristán; el reconocimiento a la figura de Einstein como ejemplo de científico que no renuncia a otros modos de conocimiento; y la reflexión sobre la filosofía de la ciencia en la segunda mitad del siglo XX, el autor nos muestra la necesidad de un diálogo entre cultivadores de la ciencia y las humanidades para afrontar los desafíos del siglo XXI. In his recent Editorial Article, Jeffrey Seeman calls for the promotion of collaborative work among different disciplines, focusing on the case of the interaction between chemistry, the history of chemistry and the philosophy of chemistry. From a general viewpoint, it is difficult to disagree with this claim; moreover, the interest of scientists in the history and the philosophy of science is always welcome. However, the devil is in the details: there are several points that, we think, must be discussed more (...) carefully with the aim of arriving at far-reaching conclusions. (shrink)

Although during the last decades the philosophy of chemistry has greatly extended its thematic scope, the main difficulties appear in the attempt to link the chemical description of atoms and molecules and the description supplied by quantum mechanics. The aim of this paper is to analyze how the difficulties that threaten the continuous conceptual link between molecular chemistry and quantum mechanics can be overcome or, at least, moderated from the perspective of BM. With this purpose, in “The quantum-mechanical challenges” section (...) the foundational incompatibility between chemical and SQM descriptions will be briefly recalled. “Bohmian mechanics” section will be devoted to explain the main features of BM. In “Empirical equivalence and underdetermination” section, the consequences of the empirical equivalence between SQM and BM will be discussed. Finally, in the Conclusion, we will stress the scope of the obtained conclusions and the philosophical difficulties that still remain even after adopting BM for foundational purposes. (shrink)

Is behavioral integration a necessary feature of belief in folk psychology? Our data from over 5,000 people across 26 samples, spanning 22 countries suggests that it is not. Given the surprising cross-cultural robustness of our findings, we argue that the types of evidence for the ascription of a belief are, at least in some circumstances, lexicographically ordered: assertions are first taken into account, and when an agent sincerely asserts that p, nonlinguistic behavioral evidence is disregarded. In light of this, we (...) take ourselves to have discovered a universal principle governing the ascription of beliefs in folk psychology. (shrink)

Perhaps the hottest topic in the philosophy of chemistry is that of the relationship between chemistry and physics. The problem finds one of its main manifestations in the debate about the nature of molecular structure, given by the spatial arrangement of the nuclei in a molecule. The traditional strategy to address the problem is to consider chemical cases that challenge the definition of molecular structure in quantum–mechanical terms. Instead of taking that top-down strategy, in this paper we face the problem (...) of the reduction of molecular structure to quantum mechanics from a bottom-up perspective: our aim is to show how the theoretical peculiarities of quantum mechanics stand against the possibility of molecular structure, defined in terms of the spatial relations of the nuclei conceived as individual localized objects. We will argue that, according to the theory, quantum “particles” are not individuals that can be identified as different from others and that can be reidentified through time; therefore, they do not have the ontological stability necessary to maintain the relations that can lead to a spatially definite system with an identifiable shape. On the other hand, although quantum chemists use the resources supplied by quantum mechanics with successful results, this does no mean reduction: their “approximations” add certain assumptions that are not justified in the context of quantum mechanics or are even inconsistent with the very formal structure of the theory. We distinguish two pathways people may follow when they join violent groups: compliance and internalization. Compliance occurs when individuals are coerced to join by powerful influence agents. Internalization occurs when individuals join due to a perceived convergence between the self and the group. We searched for evidence of each of these pathways in field investigations of former members of two renowned terrorist organizations: the Liberation Tigers of Tamil Eelam and Islamist radical groups. Results indicated that ex-fighters joined LTTE for reasons (...) associated with both compliance and internalization but that ex-fighters joined Islamist radical groups primarily for reasons associated with internalization. When compliance occurred, it often took the form of coercion within LTTE but involved charismatic persuasion agents within Islamist groups. This evidence of systematic differences in the reasons why fighters enter violent groups suggests that strategies for preventing radicalization and fostering de-radicalization should be tailored to particular groups. Sometimes, art theory addresses the same type of image from discursive disparity. This is the case of the portrait, whose imprecise definition complicates its conceptual and formal definition within the limits of the Western culture. Although this text does not intend to resolve doubts about one of the most significant questions in art—even the question of art, if portraits are born with it—it does attempt to show the difficulties in reaching an agreement on the conventions that define it, from its (...) antecedents in Antiquity and its establishment in modern times, up to the advent of its contemporary crisis that some authors attribute to the saturation suffered by the image in mass society, and others, to the new artistic paradigm that is imposed from Impressionism onwards. In order to design and implement electronic institutions that incorporate norms governing the behavior of the participants of those institutions, some crucial steps should be taken. The first problem is that human norms are (on purpose) specified on an abstract level. This ensures applicability of the norms over long periods of time in many different circumstances. However, for an electronic institution to function according to those norms, they should be concrete enough to be able to check them run time. A (...) second problem is that norms describe which behavior is desirable and permitted, but not how this is achieved in an institution. In the “real world" regulations often indicate procedures for implementing and enforcing the law. Likewise we should devise means to annotate the norms with practical aspects such as enforcement mechanisms, sanctions, etc. in order to get requirements for an institution that will enforce norms (by either constraining behavior within the norms or reacting to violation of the norms). The choice of which kind of mechanism is chosen is not a normative one, but usually based on criteria of efficiency and/or feasibility of the mechanism. In this paper we present our view on how to approach these problems and other related issues to be solved in order to develop e-institutions capable to operate in complex, highly regulated scenarios. La última década ha supuesto un renovado interés por la filosofía de Wilfrid Sellars. Este libro representa el paradigma de este renovado interés, si bien no es el único. Gracias al trabajo editorial de James O’Shea, la mayoría de las presentaciones de la Sellars Centenary Conference, que tuvo lugar en la University College Dublin, en 2012, fueron editadas y compiladas en este volumen. En la mencionada conferencia, varios herederos de Sellars hicieron explícita su influencia, elaboraron críticas concienzudas, o extendieron algunas (...) de las ideas del que para muchos de ellos es su principal mentor intelectual. De ahí el título del volumen, del que la mayoría de las contribuciones adopta una línea parricida. En esta reseña quiero desta- car la trama principal de cada una de las contribuciones, de forma que sea visible la diversidad de las cuestiones filosóficas en las que se juega la influencia de Sellars. Digital contact tracing, in combination with widespread testing, has been a focal point for many plans to “reopen” economies while containing the spread of Covid‐19. Most digital contact tracing projects in the United States and Europe have prioritized privacy protections in the form of local storage of data on smartphones and the deidentification of information. However, in the prioritization of privacy in this narrow form, there is not sufficient attention given to weighing ethical trade‐offs within the context of a public (...) health pandemic or to the need to evaluate safety and effectiveness of software‐based technology applied to public health. Experimental balance is usually understood as the control for the value of the conditions, other than the one under study, which are liable to affect the result of a test. We discuss three different approaches to balance. ‘Millean balance’ requires identifying and equalizing ex ante the value of these conditions in order to conduct solid causal inferences. ‘Fisherian balance’ measures ex post the influence of uncontrolled conditions through the analysis of variance. In ‘efficiency balance’ the value of the antecedent conditions (...) is decided ex ante according to the efficiency they yield in the estimation of the treatment outcome. Against some old arguments by Worrall, we show that in both Fisherian and efficiency balance there are good reasons to randomize the allocation of treatments, in particular when there is no agreement among experimenters as to the antecedent conditions to be controlled for. Research on value congruence rests on the assumption that values denote desirable behaviors and ideals that employees and organizations strive to approach. In the present study, we develop and test the argument that a more complete understanding of value congruence can be achieved by considering a second type of congruence based on employees’ and organizations’ counter-ideal values. We examined this proposition in a time-lagged study of 672 employees from various occupational and organizational backgrounds. We used difference scores as well as (...) polynomial regression and response surface analyses to test our hypotheses. Consistent with our hypotheses, results reveal that counter-ideal value congruence has unique relations to employees’ trust in the organization that go beyond the effects of ideal value congruence. We discuss theoretical and practical implications of this expanded perspective on value congruence. (shrink)

This study examines whether character strengths predict resilience (operationalized as stable or higher mental health and subjective well-being despite an adverse event) over a period of approximately one month during the COVID-19 pandemic lockdown in Spain. Using a longitudinal design, participants (N = 348 adults) completed online measures of sociodemographic data, information regarding their situation in relation to the COVID-19, character strengths, general mental health, life satisfaction, positive affect and negative affect. All variables were measured at Time 1 and Time (...) 2, except for sociodemographic and most COVID-related information (Time 1 only). Time 1 data collection was conducted between March 21, 2020 and April 2, 2020, i.e., approximately the second week of lockdown in Spain. Time 2 data collection was conducted between April 24, 2020 and May 18, 2020, after the Spanish government announced ita intention to progressively release the lockdown. A principal component analysis of character strengths was conducted. Five character strength factors were extracted: fortitude, goodness, intellectual, interpersonal, and restraint. Factor structures at Times 1 and 2 were highly consistent. All character strength factors at Time 1 correlated positively with life satisfaction and positive affect, and negatively with negative affect and mental health at T2 (higher scores in the mental health measure indicate poorer mental health). Fortitude strengths showed the highest correlations. We conducted a series of regression analyses with strength factors at Time 1 as predictors, and mental health, life satisfaction, and positive and negative affect as dependent variables, controlling for their baseline levels. To test the directionality of the relationship between strengths and the dependent variables, all analyses were reversed. All character strength factors predicted an increase in mental health. They also predicted positive affect, with the exception of strengths of restraint. Fortitude, intellectual and interpersonal strengths predicted an increase in life satisfaction. Finally, fortitude strengths, interpersonal strengths, and strengths of restraint, predicted a decrease in negative affect. None of the reversed analyses yielded significant effects. Limitations, implications, and possible character strengths-based interventions aimed at promoting mental health in the COVID-19 pandemic are discussed. (shrink)

Gastrulation is a key milestone in the development of an organism. It is a period of cell proliferation and coordinated cellular rearrangement, that creates an outline of the body plan. Our current understanding of mammalian gastrulation has been improved by embryo culture, but there are still many open questions that are difficult to address because of the intrauterine development of the embryos and the low number of specimens. In the case of humans, there are additional difficulties associated with technical and (...) ethical challenges. Over the last few years, pluripotent stem cell models are being developed that have the potential to become useful tools to understand the mammalian gastrulation. Here we review these models with a special emphasis on gastruloids and provide a survey of the methods to produce them robustly, their uses, relationship to embryos, and their prospects as well as their limitations. Understanding the mechanisms of early embryonic patterning and the timely allocation of specific cells to embryonic regions and fates as well as their development into tissues and organs, is a fundamental problem in Developmental Biology. The classical explanation for this process had been built around the notion of positional information. Accordingly the programmed appearance of sources of Morphogens at localized positions within a field of cells directs their differentiation. Recently, the development of organs and tissues from unpatterned and initially identical (...) stem cells (adult and embryonic) has challenged the need for positional information and even the integrity of the embryo, for pattern formation. Here we review the emerging area of organoid biology from the perspective of Developmental Biology. We argue that the events underlying the development of these systems are not purely linked to “self‐organization,” as often suggested, but rather to a process of genetically encoded self‐assembly where genetic programs encode and control the emergence of biological structures. El campo interpretativo sobre la obra de Newton ha sido ampliamente discutido y, particularmente, el tema de las hipótesis no ha sido la excepción. El objetivo de este texto es mostrar que la filosofía natural de Newton pareciera, en principio, rechazar la hipótesis, pero en realidad no es opuesta a la formulación de estas, si diferenciamos a qué tipo de hipótesis se hace referencia. Así pues, se muestra, en primer lugar, cómo desarrolla Newton su filosofía natural, y cómo es contrapuesta (...) a las hipótesis. Luego se muestra que bajo condiciones determinadas las hipótesis son aceptadas. Y, por consiguiente, se concluye que la filosofía de Newton no rechaza radicalmente las hipótesis, sino que, por el contrario, se puede valer de su formulación para el progreso de la investigación científica, dependiendo a qué tipo de hipótesis se haga referencia. The rapidly advancing field of brain-computer (BCI) and brain-to-brain interfaces (BBI) is stimulating interest across various sectors including medicine, entertainment, research, and military. The developers of large-scale brain-computer networks, sometimes dubbed ‘Mindplexes’ or ‘Cloudminds’, aim to enhance cognitive functions by distributing them across expansive networks. A key technical challenge is the efficient transmission and storage of information. One proposed solution is employing blockchain technology over Web 3.0 to create decentralised cognitive entities. This paper explores the potential of a decentralised web (...) for coordinating large brain-computer constellations, and its associated benefits, focusing in particular on the conceptual and ethical challenges this innovation may pose pertaining to (1) Identity, (2) Sovereignty (encompassing Autonomy, Authenticity, and Ownership), (3) Responsibility and Accountability, and (4) Privacy, Safety, and Security. We suggest that while a decentralised web can address some concerns and mitigate certain risks, underlying ethical issues persist. Fundamental questions about entity definition within these networks, the distinctions between individuals and collectives, and responsibility distribution within and between networks, demand further exploration.
